Josiah Skinner of Madison, Montgomery County, Ohio transcribed and submitted by Sande S. Skinner. IN the name of the Benevolent Father of all I, Josiah F. Skinner of the Township of Madison in the County of Montgomery int he State of Ohio, do make and publish this my Last will & Testament. Item First. It is my will that my just debts and funeral expenses shall be first be paid out of my personal Estate. Item Second. All the balance of my personal Estate and personal property of whichever kind, I give & bequeath to my beloved wife ELIZABETH SKINNER to be to her & her heirs forever. Item Third. If I shall not sell my Real Estate in my lifetime, then my Executors shall sell all my Real Estate which of I may die possessed, as soon after my decease, as convenient, either at private or public sale. with as per such terms of Payment as they shall deem best for the benefit of my Estate; and they shall have full power to Execute a Deed or Deeds in fee simple to purchases of the same; and they shall have full power to take care of my Real Estate, to preserve the same untill they shall sell it. Item Fourth. Out of the proceeds of the sale of my Real Estate my Executors shall pay to my beloved wife Elizabeth Skinner the sum of one thousand dollars to be to her & her heirs forever; Item Fifth. Out of the same proceeds of the sale of my said Real Estate my Executors shall pay to my daughter Rebeca Ann Stoner, one thousand dollars to be to her & her heirs forever; Item Sixth. Out of the proceeds of the sale of my Real Estate my Executors shall pay to my son MORRIS SKINNER the sum of Ten Dollars to be to him & his heirs forever; the said sum of Ten Dollars is all that my said son MORRIS SKINNER shall receive out of my Estate, and no more. Item Seventh. After paying or deducting the bequests named in Items 4, f and 6, from the whole sum of proceeds from my Real Estate, my Executors shall put the balance of said proceeds at interest, well secured, during the lifetime of my said wife ELIZABETH SKINNER, and annually pay to her out of said Interest the sum of three hundred dollars so long as she shall live. Item Eight. After the death of my said wife ELIZABETH SKINNER, my said Executors shall distribute the said Balance of the proceeds of my Real Estate together with my accumulated Interest therein, in equal proportions to my grandchildren herin named to wit MARY JANE STONER, WILLIAM FREEMAN STONER, & FANNIE ALICE STONER, children of my daughter Rebeca ANN STONER; & Charles M. HIGGINS, HORACE MANN HIGGINS, children of my daughter MARY HIGGINS Deceased. If my daughter REBECA ANN STONER, shall have other children born to her at the time of said distribution, they shall share equally in said distribution, with all my grandchildren herein named, the same as if their names were here inserted. Item Nine. I do hereby constitute and appoint Morris Stillwell and THOMAS R. WILLARD Executors of this my Last Will and Testament; and I do hereby revoke and make void all former Wills by me made, I desire that no appraisement of my personal Estate shall be made.
